What is BESO?
Effective December 1, 2015, the Building Energy Saving Ordinance (BESO) will replace both the Residential and Commercial Energy Conservation Ordinances (RECO and CECO), requiring that Berkeley buildings (less than 25,000 sqft) complete an energy assessment and publicly report energy efficiency information to the City and potential buyers prior to sale. BESO assessment is required prior to the sale of a house of whole building. With BESO, the RECO/CECO requirements of installing energy and water efficiency improvement measures, will no longer be required. Transition from RECO to BESO
The transition from RECO to BESO will begin on October 9, 2015. Sellers may choose to comply with either RECO or BESO. The advantage of complying with BESO is that, the mandatory energy and water efficiency improvement measures required by RECO do not apply to BESO. Sellers only need to complete an energy assessment and share the report with the City and potential buyers.
Rebates available for Early Compliance
The City of Berkeley is offering a limited-time rebate up to $200 for a BESO energy assessment with a Home Energy Report. Rebates are available while funds last. To qualify for the rebate, applicant must be the owner of a single-family (1-unit) house located within Berkeley and the house must not be listed for sale or currently in contract for sale at the time of the application or have a RECO or BESO Form C deferral on file.
High Performance Exemption
If you complete an energy upgrade that qualifies for the Energy Upgrade California Home Upgrade rebate, your house will be exempt from the BESO compliance. You can apply for a High Compliance Performance by submitting the rebate approval notice to Berkeley. If you are considering this option, we recommend you schedule a full home energy assessment along with the BESO assessment, this way you can take advantage of both the $200 BESO rebates and the $300 Energy Upgrade California assessment rebate.
